Introduction
Law 18-07 relating to the protection of individuals in the processing of personal data entered into force on August 10, 2023, in accordance with article 75.
The law No. 18-07, in accordance with article 4, applies to the processing of personal data carried out by public bodies or private persons:

1 -   When it is carried out by a natural or legal person whose manager is established on Algerian territory or on the territory of a State whose legislation is recognized as equivalent to national legislation regarding the protection of personal data. A data controller who carries out an activity on Algerian territory within the framework of an installation, whatever its legal form, is considered to be established in Algeria.

2 -  When the person responsible is not established on Algerian territory but uses, for the purposes of processing personal data, automated means or not, located on Algerian territory, excluding processing which is only used 'for transit purposes within the national territory.

Excluded
The processing mentioned in Articles 5 and 6 of the law, in particular processing carried out by a natural person in the context of their personal activities, provided that they are not intended for communication to third parties or for dissemination.
